Your online acceptance of this Agreement will have the same legal effect as if you were providing a handwritten signature of acceptance.
1. Services Provided
Show Me The Number offers you, among other things, the ability to find out who called you from a withheld, blocked, or unknown number. The real telephone number of the caller is sent as a text message to the number you signed up to the service with. This number can be changed at any time by contacting us.
2. Acceptable Conduct
You agree to use the services only for lawful purposes. You shall not transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, national or internation law. We reserve the right to immediately and without notice suspend or terminate your Account in the event it determines that you have violated any such law or regulation, or any term or condition of this Agreement. We reserve the right to terminate your Account or use of the service in the event of a violation of this policy.
3. Conditional Call Forwarding
Our technology is based on your phone’s conditional call-forwarding feature. Conditional call-forwarding operates by forwarding ALL busy and unanswered calls to Show Me The Number number for handling. By becoming a customer, you acknowledge that the use of the service requires conditional-call forwarding and that we will use its our own servers to handle these calls. Once the call has been forwarded to our servers, the caller will simply hear a standard UK dial tone. No messages, advertisements, recording or further handling or forwarding occurs. You are solely responsible for any charges by your phone provider for using the conditional call-forwarding feature. We use standard rate landline numbers which are included in any contractual inclusive minutes.
4. Opening an Account
In order to become a customer, you must complete an application form on the Website. For an account you will need to provide your name, mobile number, email address and home address and valid payment information. As part of the application, you will be provided with a dedicated call forwarding access number. We will then send you an electronic notification confirming that you have become a customer.
Our service is a monthly rolling service that costs £5.99 per month. The service automatically renews each month and the payment details used at signup will be charged a further £5.99 per month. You may cancel the service at any time; we do not impose a cancellation charge or minimum term.
6. Email Notification
You are responsible for maintaining a current and operational email address and for reading email from us and so that we can notify you of updates to our service and any customer account information.
7. Consent to Communications
By entering into this agreement, you consent to the receipt of electronic mail (“e-mail”) from us and customer service communications. In addition to sending you e-mail notifications as provided for above. We may also communicate to you by sms message in relation to your service with ourselves, however your information including your email address and mobile phone number will never be used for marketing messages either by ourselves or 3rd parties.
8. Ownership of Account
We recognizes the person whose name is listed on the Account as the sole owner of the Account, even where payment on the Account is made using the credit card of a parent or other person.
9. Acceptable Use
Show Me The Number is a personal use service and not intended for commercial use. It is engineered to process information for typical phone usage. We may monitor your usage of the subscription plan and if it concludes that you are using a personal account for commercial purposes, we may, at our discretion, discontinue service or work with you to fashion a custom solution. There is no specific minimum that will trigger an investigation into commercial usage, and any usage over 30 Unmasked Blocked Calls a month will be deemed commercial usage and subject to service discontinuance without any further inquiry. "Unmasked Blocked Calls" is defined as the use of our system revealing phone numbers that are forwarded from a subscribers phone.
10. Impermissible Use
We evaluate customer usage in comparison to typical levels of permissible usage engaged in by legitimate customers (mobile subscribers, residential subscribers, average mobile small business usage).
Each of the following is impermissible under our subscription and considered outside of normal usage.
Forwarding calls from a call center to an account Auto-dialing to an account.
11. Payment, Refunds, Upgrading and Downgrading Terms
1. A valid credit card is required to sign up for our service. When signing up you will be charged £5.99, and £5.99 per month thereafter until such a time that you cancel per our cancellation terms (12), below.
2. If you initially signed up during a free trial period, and you cancel before the trial period has expired, the pre-authorisation will be cancelled from your payment card. Trial periods are only offered as a promotion from time to time. If you were not offered a trial period during your sign up, you will be charged upon creating your account as per the prices states on the signup webpage.
3. The service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, service upgrades or downgrade refunds, or periods when the account holder does not use the service. In order to treat everyone equally, no exceptions will be made.
4. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities directly on the services, and you shall be responsible for payment of all such taxes, levies, or duties.
You may discontinue the service at any time by requesting cancellation. You can do this by email, text message or live chat. We respond to queries usually within the hour, during working hours. We will then shut down access to your Account. You will not be entitled to any refund of the unused balance in your Account if you discontinue service. Additionally, you will remain responsible for payment of all charges for services rendered up through the date you discontinue service.
You are solely responsible for properly deactivating the service from your handset after cancellation as provided in the cancellation instructions on our website. Failure to properly deactivate the divert to our service may result in call costs, or diverted calls being sent to the new owner of any divert number that has been re-allocated by ourselves.We retain ownership of all divert numbers issued upon account creation and they are rented to you for the duration of your account being active.
We reserve the right, at its sole discretion and for any reason, to (a) terminate this agreement and your access to its services, upon five (5) days electronic notice. If fraud is suspected, we have the right to put an Account immediately on hold until further investigation takes place.
14. No Warranties
SHOW ME THE NUMBER LTD DOES NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH REGARD TO THE MERCHANTABILITY, TECHNICAL COMPATIBILITY OR FITNESS FOR A PARTICULAR PUPOSE OF ANY SERVICE, PRODUCTS OR MATERIAL PROVIDED FOR PURSUANT TO THIS AGREEMENT.
You agree to indemnify, defend and hold SHOW ME THE NUMBER, its officers, directors, employees, agents, shareholders, licensors, suppliers and any third party information providers to the Website, harmless from and against all claims, actions, proceedings, expenses, damages and liabilities, including legal fees, which are the result of, or are in any way related to, your use of the Website or SHOW ME THE NUMBER LTD services, including use in transactions or communications with third parties.
If any provision of this agreement is held to be invalid, illegal or unenforceable, the remaining provisions will of this agreement will continue in full force and effect.
17. Governing Law
This agreement, and all modifications/amendments thereto, shall be governed by the law of the United Kingdom, without giving effect to its conflicts of laws principles.
